What are the key features that make Malta an attractive jurisdiction for the registration of vessels and aircraft?

The key proposition is simple: a respected EU flag combined with pragmatic regulation, speed and cost-efficiency.

In maritime, Malta is one of the largest and most established ship registers globally. It provides a strong legal framework, creditor-friendly laws, efficient registration processes, and reasonable fees.

In aviation, Malta’s aircraft register has grown significantly due to its EASA-compliant regime, experienced and efficient Civil Aviation Directorate, and a robust legal framework which supports all aspects of the industry. From a structuring perspective, Malta also offers attractive tools such as accelerated depreciation and efficient corporate frameworks for ownership and leasing platforms.

In 2025, significant changes were made to Malta’s ship registration framework, especially with respect to financing. What are these changes, and how can prospective investors benefit from them?

Malta has recently modernised its maritime financing framework through legislative amendments, introducing, among others, the finance charter instrument as a registrable security. This means that lessors and financiers in leasing structures now have an additional layer of protection beyond traditional mortgages. The law also strengthens enforcement mechanisms, clarifies priorities of registered securities and enhances Malta’s position as a creditor-friendly jurisdiction.

For investors and financial institutions, it provides greater legal certainty, improved protection in asset-backed financing structures and flexibility in structuring complex international deals, enhancing Malta’s appeal for yacht and ship financing, particularly for leasing platforms and structured asset portfolios.

What are the main challenges or obstacles anyone registering a vessel or aircraft in Malta should look out for?

As a jurisdiction of choice, Malta offers a flexible environment, however, it is essential that clients are mindful of the fact that Malta is a highly regulated jurisdiction and the required paperwork, in specific formats, needs to be in place. From a technical perspective – both the ship and aircraft registries adhere to a strict set of regulations which must be met for the aircraft/vessel to be included in the Maltese register.

Clients are often surprised by how accessible and efficient Malta is. The practicality and expertise of the relevant authorities are regularly praised by various clients.

What is Malta’s attraction for superyacht owners specifically?

Key attractions include a highly respected and recognised EU flag, an efficient registry which is available 24 hours, seven days a week if required, an increasingly modern regulatory framework, including the updated Commercial Yacht Code, and a strong legal framework which facilitates sales and financed transactions. Add the ability to structure ownership and operations through corporate frameworks tailor-made for the maritime industry, and Malta emerges as a jurisdiction offering a very strong combination of reputation, flexibility and infrastructure for superyacht owners.
